1. Scope
These Terms and Conditions (the “Terms”) apply to all contracts between vu7 and users of the vu7.sh platform (the “User”). Any conflicting terms of the User are not accepted.
Where the User acts as a consumer within the meaning of Section 1(1)(2) of the Austrian Consumer Protection Act (KSchG), the mandatory provisions of the KSchG and the Austrian Distance and Off-Premises Contracts Act (FAGG) also apply. In the event of a conflict between these Terms and mandatory consumer protection provisions, the statutory provisions prevail.
2. Description of services
vu7 provides a web-based platform for automated security scans. The User can define target systems (IP addresses, domains and repositories) and commission scans against advance payment. Based on the scan results, vu7 prepares a report on the vulnerabilities identified.
vu7 is required to perform the scan and produce a report, but is not required to identify every existing vulnerability. The platform does not replace manual penetration testing by qualified security professionals. Results reflect the state of the art at the time of the scan.
3. Formation of the contract
The contract is concluded when the User configures a scan, completes the order by clicking the relevant button and payment has been successfully processed. Once payment is complete, the User receives an email confirmation. Entitlement to the scan arises only after successful payment.
4. Prices and payment
All prices are in euros and include statutory VAT unless expressly stated otherwise. Payment must be made in advance before the scan is performed. Payments are processed through Stripe.
5. The User’s obligation to obtain authorisation
With each scan order, the User makes a binding and truthful declaration that they are legally authorised to test the specified target systems for vulnerabilities. This requires the User either to own the systems or to hold the owner’s express written permission.
Scanning systems without the required authorisation is prohibited and may constitute a criminal offence under Section 118a of the Austrian Criminal Code (StGB), concerning unlawful access to a computer system. vu7 accepts no liability for damage resulting from unauthorised use of the platform. Where there are reasonable grounds to suspect unauthorised use, vu7 may suspend the User’s account without prior notice and inform law enforcement authorities.
6. Consumers’ right of withdrawal
Consumers within the meaning of the KSchG generally have the right to withdraw from the contract within 14 days without giving a reason (Section 11 FAGG). The withdrawal period begins on the date the contract is concluded.
The User expressly agrees that vu7 will begin performing the scan immediately upon receipt of payment. The User acknowledges that they lose their right of withdrawal once the scan has been fully performed (Section 18(1)(1) FAGG). If the scan has not yet started, withdrawal may be declared by email.
7. Prohibited use
The platform may be used only for lawful purposes. In particular, it is prohibited to scan systems without authorisation, use the platform to prepare or carry out cyberattacks, disclose scan results to third parties who could use them to gain unauthorised access, or make automated requests or misuse the API in breach of the terms of use.
In the event of a breach, vu7 may suspend the account without prior notice and without a refund, and may take legal action.
8. Liability
vu7 does not guarantee the completeness of scan results. The platform does not claim to detect every vulnerability present in a system. The User is responsible for decisions made on the basis of scan results.
Limitations of liability do not apply to personal injury or to claims under the Austrian Product Liability Act (PHG) and the Austrian Data Protection Act (DSG).
9. Privacy
Personal data is processed in accordance with our Privacy Policy and the GDPR.
10. Confidentiality of scan results
Scan results and reports are confidential and intended solely for the User who commissioned them. vu7 does not disclose scan results to third parties unless the User expressly consents or disclosure is required by law.
11. Availability
vu7 strives to maintain high platform availability but does not guarantee it. Maintenance work will be announced where possible. If the service is unavailable for technical reasons after payment has been made, the scan will be performed at the earliest available opportunity or the payment will be refunded.
12. Changes to these Terms
vu7 reserves the right to amend these Terms with reasonable advance notice of at least 30 days. Registered users will be notified by email. Continued use of the platform after the notice period expires constitutes acceptance of the amended Terms. Consumers have a special right of termination in this case.
13. Applicable law and jurisdiction
Austrian law applies, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG). For consumers, statutory jurisdiction applies in accordance with Sections 14 and 83c of the Austrian Jurisdiction Act (JN); mandatory consumer protection provisions of the consumer’s country of residence remain unaffected.
The former EU Online Dispute Resolution platform was discontinued on 20 July 2025. Information about out-of-court consumer dispute resolution is available on the European Commission’s Consumer Redress portal.
14. Severability
If any provision of these Terms is or becomes invalid, the remaining provisions remain valid. The invalid provision shall be replaced by a valid provision that most closely reflects its economic purpose.
